This personal data and privacy policy is formulated in accordance with the Personal Data Protection Act 2010 (“Act”). For the purpose of this Privacy Policy, (i) “Personal Data” shall have the meaning as ascribed to it in the Act; and (ii) Johan” shall refer to Johan Holdings Berhad and any of its subsidiaries, related and associated companies and affiliates.

1. You have in the past and may or will in the future be required to provide Personal Data to Johan in connection with and/or in the course of your dealings with Johan. Your Personal Data may also be acquired by Johan from publicly available sources and from sources within Johan.
2. Although the precise details of the Personal Data collected will vary according to the specific purpose, the Personal Data that may be collected from you includes your name, NRIC number/passport number, address, e-mail address, telephone number, photographs, financial position, family members and personal information about them (and in respect of job applicants, includes qualifications, employment history, knowledge, experience and expertise).
3. Please note that in the event that sufficient Personal Data is not supplied or is not satisfactory then your application or request to Johan for any of the above purposes as set out herein may not be accepted or acted upon and/or Johan will not be able to provide services or benefits to you or otherwise deal with you.
4. Your Personal Data may be used or processed by Johan or on its behalf for the following purposes:-
   a. carrying out your instructions, providing products and/or services, evaluating and assessing suitability for employment (where relevant) and responding to enquiries by you or made on your behalf ;
   b. researching, designing, launching, promoting and marketing products and services of Johan and monitoring the provision, operation and use of such services or products;
   c. provision of reference (status enquiries);
   d. carrying out credit and other status checks;
   e. purposes connected with the operation, administration, development or enhancement of Johan’s business including for the purpose of which is relevant to support and/or or assist in any of Johan’s businesses (for example, providing information on you and on your working experience to fulfil information as required for the submission of tenders for projects or for fulfilling regulatory requirements;
   f. where required by law, Johan’s considers that such use or disclosure is necessary to respond to any claims or legal process, or where Johan suspects that fraud or unlawful activity has been, is being or may be engaged in;
   g. where a third party requires in order for such third party to perform functions or services as required by Johan (for example, to insurance companies who are arranging for Johan’s hospitalisation or accident policy and to banks who are arranging for salary remittances (for employees) and to bank for scholarship disbursements and living expenses payments;
   h. meeting any legal, governmental or regulatory requirements in Malaysia or any other applicable jurisdiction, including disclosure or notification requirements;
   and any other incidental and associated purposes relating to any of the above.
5. Your Personal Data will be kept confidential but it may be provided to:-
   a. any person under a duty of confidentiality to Johan;
   b. any company or division within Johan and/or to third parties including but not limited to Johan ‘s project employers, contractors, suppliers and partners;
   c. any relevant agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment, securities clearing, management, audit, insurance, professional or other services to Johan holdings;
   d. any credit reference agency and in default debt collection agencies or similar provider of debt collection or credit information services to Johan;
   e. lawyers, auditors, tax advisors, investment banks, and other professional advisors;
   f. any insurance company and any association or federation of insurance companies (whether or not based in Malaysia);
   g. any person or corporation to whom Johan Holdings transfers or proposes to transfer its interests and/or obligations in respect of you or any product or service provided to you;
   h. any person by whom Johan Holdings is required by applicable legal, governmental or regulatory requirements to make disclosure;
   any other person reasonably requiring the same in order for Johan Holdings to carry out the purposes permitted above.
6. Your Personal Data shall be stored either in hard copies in Johan Holdings offices or stored in servers located in or outside Malaysia and operated by Johan Holdings or its service providers in or outside Malaysia. Any Personal Data supplied by you will be retained by Johan Holdings as long as necessary for the fulfilment of the purposes stated above or is required to satisfy legal regulatory, accounting requirements or to protect Johan Holding’s interests.
7. You are entitled to ask whether Johan Holdings holds data on you and to request access to and the correction of any such data held. A reasonable fee will be charged for processing each data access request. Requests for access to or correction of data held by Johan, should be addressed to :-

8. Please ensure that your personal data such as contact details including your addresses, your telephone numbers (including your mobile telephone number), e-mail address and other details are up to date.

Johan Holdings reserves the right to amend this Privacy Policy from time to time without prior notice. Johan Holdings advises that you check this Privacy Policy on a regular basis. A copy of the Privacy Policy is available from the Human Resource Department, Johan Holdings Bhd.

In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Privacy Policy, the English version shall prevail.
